A new offer usually comes with a start date, and the start date rarely matches the notice clause in the old contract. The gap between the two gets handled as a scheduling problem. It is actually a pricing problem, and the price is written into the law in plain dirhams.

What the UAE labour law says the notice period costs

Article 43 of Federal Decree-Law No. 33 of 2021 sets the notice period between 30 and 90 days, as agreed in the contract, and it runs both ways. The employer gives it to end the contract and the employee gives it to resign. Clause 3 prices the breach:

“The party who did not abide by the notice period shall pay to the other party compensation, which is called notice period allowance, even if the absence of notification does not cause damage to the other party and the compensation shall be equal to the worker’s wage for the full notice period or the remaining part thereof.”

Two phrases in that sentence carry the money. “Even if the absence of notification does not cause damage” means the employer does not have to prove an early exit hurt the business. The allowance is owed by default. And “the remaining part thereof” means the bill covers only the days not served, not the whole period.

Clause 4 then says the allowance is calculated on “the last wage received by the worker”. A raise in the final year therefore prices the shortfall at the new number.

Why the notice allowance uses your full wage, not your basic

This is the part I find most people get wrong, and it is a definitions problem. Article 1 of the same law defines two different things. Basic Wage is the contract wage “which does not include any other allowances or benefits in-kind.” Wage is “the basic wage, in addition to the cash allowances and benefits in-kind” allocated under the contract, so cash allowances such as housing and transport sit inside it.

Article 43 uses “wage”. Article 51, the gratuity article, says end-of-service benefits are “calculated according to the basic wage”: 21 days of it for each of the first five years, 30 days for each year after.

So the same salary slip is read two ways. The notice shortfall is priced on the whole package. The gratuity already built up is priced on the basic line alone.

A worked example: 30 days short on a 60-day notice

Take a package of AED 15,000 a month: AED 9,000 basic, AED 4,000 housing, AED 2,000 transport. The contract says 60 days of notice. The employee resigns, and the new employer wants a start in 30 days.

Line Basis Amount
Notice not served 30 days of full wage AED 15,000
Gratuity earned per year (years 1-5) 21 days of basic, counting a month as 30 days AED 6,300
Years of gratuity the shortfall equals 15,000 ÷ 6,300 about 2.4 years

Thirty days of notice skipped can cost more than two years of gratuity.

None of this is a penalty in the punitive sense. It is the contract working as written, and an employer is entitled to the work it was promised or the money in its place.

At the trading company where I work, nobody signs a supplier contract without first pricing what it costs to leave it early. An employment contract is the one most of us sign without doing that sum. Running it before accepting a start date takes five minutes.

How the notice period can be shortened without the cost

Clause 2 of Article 43 allows the two parties to agree an exemption from the notice period, or a shorter one, “while preserving all the rights of the worker for the notice period agreed upon in the employment contract.” It also requires the notice period to be “the same for both parties unless it serves the interests of the worker.”

In money terms, the difference between owing AED 15,000 and owing nothing is usually a written agreement with the current employer. A verbal “fine, go early” from a manager is not a document anyone can produce later. The exact wording of the signed release, not the conversation, is what decides the final settlement.

The settlement itself has a deadline. Article 53 requires the employer to pay “his wages and all his other entitlements” within 14 days from the end of the contract. That is the figure I budget against, and the notice allowance is a line inside it.

Resigning during probation follows different numbers

Article 9 has its own rules for the first six months. To move to another employer in the UAE during probation, the worker must give written notice of “not less than one month”, and the new employer compensates the original one for recruitment costs unless agreed otherwise. To leave the country, the notice is 14 days. Break either and clause 5 applies the same formula: wages for the notice period or the remaining part. Clause 6 adds a cost that is not in dirhams: a foreign worker who leaves without following the article “shall not be granted a work permit to work in the State for one year.”

This is educational mechanics, not legal advice. The notice clause in your contract and your basic-to-allowance split decide your numbers, so run them before agreeing a start date.
